California Construction And Real Estate Attorney Settles “Failure to Disclose” Case in Placer County

April 12, 2014 by admin

Construction and real estate attorney, Robert Finkle, has recently settled a matter prior to filing a lawsuit on behalf of a homeowner against a large multi-national condominium converter.  The case involved an owner who purchased a condominium, which had been converted from an apartment unit, in 2006 located near Lake Tahoe, California.  Shortly after taking possession of the property the homeowner learned a loud previously undisclosed noise would emanate from the service elevator located near the unit, making it much less desirable.

The homeowner attempted to resolve the issue directly with the condominium converter on his own to no avail.  After many unfulfilled promises by the converter, the owner contacted and retained Mr. Finkle who immediately issued a demand.  Through negotiations with the convertor, Mr. Finkle was able to obtain a positive result for his client in less than a year without filing a lawsuit.  The converter ultimately agreed to purchase back the unit, at a rate well above market value, even though many years had passed since the original purchase.
