“Partner, Matt Schoech, recently appeared live in-studio to interview with Mark Montgomery, talk host for The Mark Montgomery Show, California’s Small Business Talk Radio, heard on Talk 650am KSTE each Saturday morning from 6-8am.  In the interview Matt Schoech touches on various subjects that are of interest to residential and commercial property owners.   One  particular issue is for new owners who are in the market for residential or commercial property and decide to purchase from a renovation company, or a “flipper”, who is in the business of buying homes in foreclosure on the courthouse steps for pennies on the dollar.  The “flippers” then often make cosmetic repairs thereby potentially concealing serious construction issues.  The “flippers” are still required under California law to disclose material facts, including repairs, but often times disclaim any knowledge of defects and make statements such as “We have never occupied the property and have no knowledge of its past or present condition.”    These types of situations could result in Failure to Disclose cases that the attorneys at Anderson | Schoech have experience in handling.

Construction defect attorney in California, Matt Schoech also shares that the average homeowner isn’t aware that they have legal rights against their builder, or general contractor for defective construction, be it new construction or remodeling jobs.  A builder may respond to a homeowner’s warranty request by sending a warranty representative to a home to inspect a stucco or foundation crack only to be told by the builder’s representative that it’s “normal cracking” or the cracks are not big enough to repair.  False representations may be made by a home warranty rep and owners should be wary of this type of response, and call a construction defect attorney to thoroughly evaluate their issues.

Another important recommendation for owners looking to hire a contractor to perform remodeling work or construction of a new home, it is important to make sure the contractor has adequate insurance to cover defective workmanship.  In an effort to cut down costs, it is not uncommon for builders/contractors to do work without general liability insurance or to purchase the cheapest policy that provides little to no coverage for the work being performed.  Before hiring a contractor owners should require proof of insurance to make sure they are covered.”
