A settlement is pending in Kern County for a single-family residence in a failure to disclose case wherein the previous occupant/hoarder kept large quantities of animals in poor condition on the property. When occupied by the animal hoarder, the property suffered extensive damage from large quantities of animal feces and urine. When Plaintiffs moved into the property, they neither knew nor suspected of any defects and problems with the property or knew of the defendants’ fraud at the time of purchase. Shortly after moving into the property the plaintiffs began experiencing health issues including, but not limited to breathing difficulty, dizziness, muscle weakness, skin irritation, and vision loss, amongst other problems. The Plaintiffs discovered the defects when strong urine and sewage smells began emanating from the property and discovered dry rot in the sub floor. Plaintiffs discovered that an animal hoarder rented the property prior to its sale and that defendants covered up the defects prior to its sale. Plaintiffs will be seeking monetary damages and the claims are being litigated on a contingency fee basis.

Personal resident home with construction defect to the base/flooring, leakage/bacht from crack in cement. Construction company "Meritage Home". Still within the 10 years under construction warranty.
